Terms of Use

Welcome to our browser-based STREAM IP Client Portal (the "Portal").

These Terms of Use ("Terms") govern your access to and use of the Portal provided by TOPPAN Digital Language (UK) Ltd ("we," "us," or "our").
By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Portal.

  1. Acceptance of Terms
By accessing or using the Portal, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is accessible here. We may update these Terms from time to time, and your continued use of the Portal constitutes acceptance of those changes. We will notify you of material changes by posting the updated Terms on the Portal with a new effective date.

  1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Portal. By using the Portal, you represent and warrant that you meet these eligibility requirements. If you are using the Portal on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

  1. Account Registration and Security
To access certain features of the Portal, you will need to create an account. You agree to:
  • Provide accurate, current and complete information during registration.
  • Maintain the security of your account by keeping your login credentials confidential.
  • Notify us immediately of any unauthorised access or use of your account.
  • Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate your account if we suspect fraudulent, unauthorised or unlawful activity.

  1. Fair Use
You agree to use the Portal only for lawful purposes and in accordance with these Terms. Specifically, you agree to:
  • Use the Portal in a manner consistent with its intended purpose; which is, to provide quotations to translate and file patents across all available routes and jurisdictions; to provide clients access to their patent portfolios and analytical data; and to provide status updates and communication channels between relevant stakeholders during the duration of an order.
  • Not engage in excessive or abusive use of the Portal, including but not limited to overloading the system, sending spam or attempting to bypass usage limits.
  • Not use the Portal to engage in any activity that disrupts, damages, or interferes with the Portal’s functionality or security.

  1. Safe Use
To ensure a safe environment for all users, you agree not to:
  • Introduce viruses, malware or any other harmful code to the Portal.
  • Attempt to gain unauthorised access to the Portal, its systems or other users’ accounts.
  • Use the Portal to infringe on the intellectual property rights, privacy rights, or other rights of any third party.

  1. Intellectual Property
All content, features, and functionality of the Portal, including but not limited to text, graphics, logos and software, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. You may not copy, modify, distribute or create derivative works from any part of the Portal without our prior written consent, except as permitted for personal, non-commercial use.

  1. User
You may be permitted to upload or submit content to the Portal ("User Content"). You retain ownership of your User Content, but by uploading it, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process such content solely for the purpose of operating and providing the Portal. You represent and warrant that:
  • You have all necessary rights to submit User Content.
  • Your User Content does not violate any third-party rights or applicable laws.
We reserve the right to remove or modify User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

  1. Prohibited Activities
In addition to the restrictions outlined in the Fair Use and Safe Use sections, you agree not to:
  • Reverse engineer, decompile, or disassemble any part of the Portal.
  • Use automated systems, such as bots or scripts, to access or scrape the Portal.
  • Interfere with or circumvent any security or access restrictions of the Portal.
  • Use the Portal for any commercial purpose without our prior written consent, unless expressly permitted.
 
  1. Privacy Policy
We collect and store your user credentials and activity data solely for the purpose of delivering and improving the services provided through the Portal. This information will not be used for any other purpose, nor will it be shared with third parties, except as required to provide the services or as mandated by law. For more details, please refer to our full Privacy Policy, accessible via the Portal and via our website.  

  1. Termination
We may suspend or terminate your access to the Portal at our sole discretion, with or without notice, if you violate these Terms or for any other reason, including but not limited to system maintenance or business decisions. Upon termination, your right to access and use the Portal will cease immediately, and you must stop using the Portal.

  1. Disclaimer of Warranties
The Portal is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Portal’s availability, functionality, or suitability for your needs. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  1. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Portal, including but not limited to loss of data, profits, or business opportunities. Our total liability for any claim arising from these Terms or your use of the Portal will not exceed £100.

  1. Indemnification
You agree to indemnify, defend, and hold harmless TOPPAN Digital Language (UK) Ltd, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Portal, violation of these Terms, or infringement of any third-party rights.

  1. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Portal will be resolved through binding arbitration in the United Kingdom. You waive any right to participate in a class action lawsuit or class-wide arbitration.

  1. Third-Party Links
The Portal may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. You access such third-party sites at your own risk.

  1. Modifications to the Portal
We reserve the right to modify, suspend, or discontinue the Portal or any part thereof at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

  1. Miscellaneous
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Portal.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion.
